Introduction and Acceptance

These Terms govern your use of the Crypto Analyst VTa app, website, pages, charts, levels, patterns, drawing tools, alerts, signals, scores, analytics, AI-assisted features, subscriptions, AI credits, feedback tools, and related services. By using the app or related pages, you agree to these Terms.

Informational Use Only

The app does not provide financial, investment, legal, tax, accounting, brokerage, exchange, custody, portfolio-management, or personalized trading advice. All charts, levels, patterns, drawings, alerts, signals, scores, news, indicators, AI outputs, explanations, and notifications are provided for informational and educational purposes only. Nothing in the app is an offer, solicitation, recommendation, instruction, guarantee, or inducement to buy, sell, hold, trade, stake, lend, borrow, or otherwise deal in any cryptoasset, derivative, futures product, token, security, commodity, or financial instrument.

No Fiduciary Relationship and No Suitability Assessment

Use of the app does not create a fiduciary, advisory, broker-client, portfolio-management, agency, employment, partnership, or professional-client relationship. The app does not know your full financial situation, investment objectives, risk tolerance, experience, tax position, jurisdiction, or personal circumstances. The app does not perform a suitability, appropriateness, or personalized risk assessment.

No Regulated Financial or Cryptoasset Service

The app is intended as software and informational content only. It does not open, close, execute, route, broker, settle, clear, transmit, place, arrange, custody, or manage trades or assets. It does not hold private keys, seed phrases, wallet access, exchange passwords, or user funds. We do not claim authorization as an investment firm, broker, exchange, custodian, financial adviser, portfolio manager, cryptoasset service provider, or similar regulated entity. Where laws in your jurisdiction require licensed advice or regulated services, you must not use the app as a substitute for such licensed services.

Cryptoasset, Futures, and Trading Risks

Trading or investing in cryptoassets and related products involves substantial risk, including the possible loss of all funds. Prices can change rapidly because of volatility, liquidity, leverage, liquidation events, funding changes, news, market manipulation, exchange outages, technical failures, regulatory changes, and third-party data errors. Futures and leveraged products can create losses faster than spot trading. Past performance, historical data, backtests, signal history, pattern examples, or AI explanations do not predict future results.

Signals, Scores, Patterns, Alerts, and AI Outputs

Signals and scores are simplified technical-analysis labels based on available market data and internal logic. Pattern detection and drawing tools are visual aids and may be approximate or imperfect. Alerts are reminders only. VTa Arbiter AI and any other AI-assisted output may be incomplete, inaccurate, delayed, biased, unavailable, or unsuitable for your circumstances. None of these outputs guarantees market direction, timing, entry, exit, profit, loss limitation, or risk level. You should not rely on any single app output as the sole basis for a decision.

Your Responsibility

You alone make all trading and investment decisions. You are responsible for your own research, risk management, position size, leverage, stop-loss decisions, account security, taxes, recordkeeping, and compliance with laws that apply to you. If you are unsure, consult an appropriately licensed professional before making any financial decision.

Subscriptions, AI Credits, and Billing

Some features may require a paid subscription or one-time AI credit purchase. Payments are processed by Google Play and are subject to Google Play terms, policies, taxes, regional availability, refund rules, and consumer rights that apply by law.

• Subscriptions: subscriptions may auto-renew unless canceled before the end of the current billing period.
• Cancellation: subscriptions can be canceled in Google Play under Payments and subscriptions. Canceling a subscription does not automatically create a refund.
• AI credits: AI credit packs are one-time purchases, not recurring subscriptions. Credits have no cash value, are not transferable, and are used only for eligible in-app AI analysis requests.
• Refunds: refund requests, where available, are handled through Google Play, our applicable policy, and mandatory consumer law.

Third-Party Services and Data

The app may use or link to third-party market data, news, analytics, AI, translation, messaging, payment, hosting, crash-reporting, app-store, or platform services. We do not control third-party content, systems, policies, availability, pricing, or accuracy. Third-party terms and privacy policies may apply.

User Content and Feedback

If you send feedback, support messages, bug reports, suggestions, or other content, you are responsible for what you submit. Do not send unlawful, abusive, confidential, private-key, seed-phrase, password, or third-party proprietary information. You grant us permission to use feedback to operate, support, secure, and improve the app without owing compensation, unless mandatory law says otherwise.

Acceptable Use

You must not misuse the app, interfere with security, attempt unauthorized access, overload services, scrape or copy data in an abusive way, reverse engineer protected parts except where law allows it, use the app for unlawful activity, or misrepresent app outputs as guaranteed advice or official recommendations.

Intellectual Property

The app, design, texts, structure, algorithms, visual elements, trademarks, and related materials are protected by intellectual property and other laws. Except for rights expressly granted to you, all rights remain with their respective owners.

Availability, Changes, and Suspension

Features, supported coins, data sources, AI behavior, calculations, prices, subscriptions, credit packs, and availability may change over time. We may update, limit, suspend, or discontinue features where necessary for security, legal compliance, technical reasons, provider changes, abuse prevention, or product improvement.

No Warranties

To the maximum extent permitted by law, the app and all related information are provided "as is" and "as available" without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, uninterrupted availability, error-free operation, profitability, non-infringement, or suitability for any trading strategy.

Limitation of Liability

To the extent permitted by law, we, our affiliates, service providers, and licensors are not liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profit, revenue, data, cryptoassets, business opportunity, goodwill, or trading losses, arising from use of or inability to use the app. You assume all risk connected with your use of the app. Nothing in these Terms limits statutory consumer rights, liability for intent or gross negligence where it cannot be excluded, or any other liability that cannot legally be limited.

Indemnity for Misuse

Where permitted by law, you agree to be responsible for losses, claims, or costs arising from your unlawful use, misuse of the app, violation of these Terms, or infringement of third-party rights.

Age, Jurisdiction, and Local Law

The app is not intended for persons under 16 years of age. You may use the app only if doing so is lawful in your jurisdiction. You are responsible for checking whether cryptoasset analysis, trading, futures, leverage, subscriptions, or AI features are permitted where you live or where you use the app.

Governing Law and Consumer Rights

To the extent permitted by mandatory law, these Terms are governed by the laws of Germany. If you are a consumer in the EU or another jurisdiction with mandatory consumer protections, those mandatory protections remain unaffected.

Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts continue to apply to the fullest extent permitted by law.

Changes to These Terms

We may update these Terms from time to time. Continued use of the app after updates means you accept the updated Terms.
